If you visit, shop or place an order with Bainbridge Pty Ltd, you accept these conditions as well as agreeing to the additional Terms and Conditions included within the current Bainbridge Price List. Please read them carefully. In addition, when you use any current or future Bainbridge Pty Ltd service or visit or purchase from any business affiliated with Bainbridge Pty Ltd, whether or not included in the Bainbridge Pty Ltd Web site, you also will be subject to the guidelines and conditions applicable to such service or business.

All items purchased from Bainbridge Pty Ltd are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

APPLICABLE LAW

DISPUTES
Any dispute relating in any way to your visit to Bainbridge Pty Ltd or to products you purchase through Bainbridge Pty Ltd shall be submitted to confidential arbitration in Australia, except that, to the extent you have in any manner violated or threatened to violate Bainbridge Pty Ltd's intellectual property rights, Bainbridge Pty Ltd may seek injunctive or other appropriate relief in any court in Australia, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of an independent arbitrator. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
SITE POLICIES, MODIFICATION, AND SEVERABILITY

We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. AGREEMENT TO OBTAIN VETERINARY ADVICE
Bainbridge Pty Ltd expressly disclaims any and all responsibility for any consequences directly or indirectly related to any use or misuse of the products found on our website or any other information provided or omitted in connection therewith. Bainbridge Pty Ltd shall not be deemed to be engaged in the practice of a Veterinarian as a consequence of providing information on this website. The provided information should not be considered complete, nor should it take the place of the supervision of a Veterinarian but is provided as information only. You must obtain suitable veterinary advice prior to the use of equipment and tools sold by Bainbridge Pty Ltd.
Price List Terms and Conditions
RESELLER PRICE (RESELLER) AND RECOMMENDED RETAIL PRICE (RRP)
All prices are current as at the date of the price list. Prices are subject to change without notice.Current pricing is available to all customers within our website (contact Bainbridge head office to order online). Incorrect pricing on purchase orders received will not be notified prior to dispatch. Customers must reference the Bainbridge website prior to ordering.
RECOMMENDED RETAIL PRICE (RRP)
The listed Recommended Retail Price (RRP) includes GST (unless otherwise stated).
RESERVATION OF TITLE
Title on the goods will only pass once the invoice has been paid in full. Claims must be made within 2 days upon receipt of goods.
FREIGHT DAMAGES AND SHORTAGES:
All claims on shortages in shipment or error in billing must be made within two (2) business days of receiving goods. Claims will not be accepted outside of this timeframe. Claims for freight damage or loss must be made immediately upon receipt of goods. If Bainbridge is not contacted immediately, Bainbridge is not liable for the damaged goods.
BACKORDERS:
Backorder items will be shipped as soon as possible, unless otherwise requested.There are no freight charges on backorders, unless the products are marked plus freight within the Bainbridge Retail Catalogue. Bainbridge reserves the right not to backorder low value items.
PAYMENT TERMS:
Terms are strictly 30 days after end of month. On the 5th day of arrears, the account will be placed on hold until the outstanding monies are paid in full. Failure to adhere to payment terms may result in account terms changed to upfront payment prior to dispatching each order.
INSURANCE:
Insurance is the Buyer's responsibility. All goods are deemed to be delivered on dispatch.
FREIGHT POLICY:
Orders over $350 (excluding GST) are sent freight free (unless marked plus freight within the Bainbridge Retail Catalogue). Orders under $350 (excluding GST) freight is charged at cost. "All Bainbridge Western Australia orders will incur a freight charge. All ""Remote Island"" locations that are not within the Australian mainland (Tasmania is considered as part of the Australian mainland, however, other islands are not), incur a freight charge." All Tasmania orders for seed products will incur a $32.50 ex GST Quarantine Inspection Charge on each order/shipment.
WARRANTIES
All warranties listed in the retail catalogue are repair warranties only. Replacement product will not be supplied unless pre-authorised with Bainbridge head office. Please contact Bainbridge to discuss any warranty issues prior to offering anything to your customer. A majority of issue are simple maintenance issues rather than quality. Products that are supplied free of charge to customers by retailers may not be replaced by Bainbridge.
RETURNS:
Returns will not be accepted without a Return Authorisation (RA) number issued by Bainbridge head office.To obtain a RA number, please complete the Returns Form which is available from returns@bainbridgevet.com.au. Bainbridge sales representatives are not authorised to accept returns and the above process must be followed. Returns are approved on a case by case basis. Returns of APVMA and other products that have an expiry date (whether marked or unmarked) will not be considered for return. All returns must be freighted by using a Tracking Number/Signature on receipt. Bainbridge is not liable for any returns that are lost or damaged during transit.
